What is a human person? Two general accounts have been offered in answer to this question. According to the one, human persons are immaterial minds or souls. According to the other, human persons are identical with the material bodies that constitute them. Both accounts have serious problems. In this dissertation I present a position that is not a version of any of the currently fashionable or unfashionable "isms"--Cartesian dualism, reductive materialism or property dualism. Taking my lead from recent work on (...) the constitution relation by Mark Johnston, E. J. Lowe, Michael Burke and David Wiggins, I argue in my dissertation for a constitution account of human persons. A constitution account of human person solves many of the problems that plague traditional dualist and materialist theories of persons while at the same time doing justice to our well founded intuitions about persons. According to the constitution view, human persons are concrete physical particulars numerically distinct from the concrete physical particulars that constitute them. Not only are the relata involved in the constitution relation--the constituting object and the constituted object--numerically distinct but they are also objects that fall under different sortals. The constitution view is not without costs. Perhaps the biggest is this: it entails that in the same region of space that presently contains my body there is another numerically distinct physical entity--Me--that shares with my body all of the same parts. This seems to raise insurmountable problems for the constitution view. I supply plausible solutions to these problems and show how the "constitution" view preserves our most deeply held and well-founded beliefs about persons. (shrink)

Kevin Corcoran offers an account of how one can be a physicalist about human persons, deny temporal gaps in the existence of persons, and hold that there is an afterlife. I argue that Corcoran's account both violates the necessity of metaphysical identity and implausibly makes an individual's existence dependent on factors wholly extrinsic to the individual. Corcoran's defence is considered, as well as Stephen Davis's suggestions on how an account like Corcoran's can defend itself against (...) these concerns. It is shown, however, that the difficulties remain in full force and, therefore, that Corcoran's account fails to reconcile physicalism, no gappy existence, and an afterlife. (shrink)

This article specifically aims to address both the economic and ethical implications of mixed communities in the US through the lens of market failure, and more specifically, the recent subprime financial crisis. Relative to the research of mixed communities and social integration efforts, I first intend to explore income mix as an explanatory variable of census tract level foreclosure rates in the state of Ohio, USA. I aim to show that counter-homogenous income communities display a greater capacity to absorb the (...) adverse affects of the recent subprime financial crisis than concentrated communities of poverty. Second, I intend to provide an ethical appraisal of foreclosure effect on vulnerable communities using John Rawls' "Veil of Ignorance" as an ethical framework by which to evaluate the "fairness" of social segregation. Ethically speaking, a Rawlsian critique exposes the sub-optimality of concentrated pockets of neighborhood deprivation, where the uneven affects of subprime foreclosures are not only disproportionately shouldered by lower-income communities, but also found to be unjust. This study is not intended to suggest the unqualified support of existing US dispersal efforts, but it does contribute to exposing the sub-optimality and injustices of inert, segregated communities. Psychological externalism is the thesis that the contents of many of a person's propositional mental states are determined in part by relations he bears to his natural and social environment. This thesis has recently been thrust into prominence in the philosophy of mind by a series of thought experiments due to Hilary Putnam and Tyler Burge. Externalism is a metaphysical thesis, but in this work I investigate its implications for the epistemology of the mental. I am primarily concerned with the (...) question whether externalism undermines the idea that a person typically knows the contents of her own thoughts, beliefs, and other propositional attitudes directly and authoritatively. I criticize arguments that have been advanced on behalf of a positive answer to this question, and argue that they rest on a faulty conception of the nature of first person authority, one which likens our access to our own minds to perception. An account of the basis of first person authority is sketched that locates our epistemic right to our self-ascriptions of propositional attitude not in our ability to discriminate among the various thought contents we might be thinking, but rather in our ability to express our thoughts, and to think with them in accordance with the norms of rationality. I consider also the question whether first person authority and externalism jointly make possible a refutation of certain forms of global skepticism, as has been famously argued by Putnam. I argue that Putnam's attempted refutation fails, because the crucial externalist claims that drive it are not knowable a priori. (shrink)

Defenders of a priori arguments for dualism assume that the Cartesian thesis that possibly, I exist but no bodies exist and the physicalist thesis that I am identical with my body, are logically inconsistent. Trenton Merricks offers an argument for the compatibility of those theses. In this paper I examine several objections to Merricks’ argument. I show that none is ultimately persuasive. Nevertheless I claim that Merricks’ argument should not be accepted. I next propose a view of persons that is (...) an alternative both to person-body identity and Cartesian dualism and offer a view of the afterlife that is compatible both with the alternative conception of persons I present and the Christian doctrine of resurrection. The syllogistic mnemonic known by its first two words Barbara Celarent introduced a constellation of terminology still used today. This concatenation of nineteen words in four lines of verse made its stunning and almost unprecedented appearance around the beginning of the thirteenth century, before or during the lifetimes of the logicians William of Sherwood and Peter of Spain, both of whom owe it their lasting places of honor in the history of syllogistic. The mnemonic, including the theory or theories it (...) encoded, was prominent if not dominant in syllogistics for the next 700 years until a new paradigm was established in the 1950s by the great polymath Jan Łukasiewicz, a scholar equally at home in philosophy, classics, mathematics, and logic. Perhaps surprisingly, the then-prominent syllogistic mnemonic played no role in the Łukasiewicz work. His 1950 masterpiece does not even mention the mnemonic or its two earliest champions William and Peter. The syllogistic mnemonic is equally irrelevant to the post-Łukasiewicz paradigm established in the 1970s and 1980s by John Corcoran, Timothy Smiley, Robin Smith, and others. Robin Smith’s comprehensive 1989 treatment of syllogistic does not even quote the mnemonic’s four verses. Smith’s work devotes only 2 of its 262 pages to the mnemonic. The most recent translation of Prior Analytics by Gisela Striker in 2009 continues the post-Łukasiewicz paradigm and accordingly does not quote the mnemonic or even refer to the code—although it does use the terminology. Full mastery of modern understandings of syllogistic does not require and is not facilitated by ability to decode the mnemonic. Nevertheless, an understanding of the history of logic requires detailed mastery of the syllogistic mnemonic, of the logical theories it spawned, and of the conflicting interpretations of it that have been offered over the years by respected logicians such as De Morgan, Jevons, Keynes, and Peirce. More importantly, an understanding of the issues involved in decoding the mnemonic might lead to an enrichment of the current paradigm—an enrichment so profound as to constitute a new paradigm. After presenting useful expository, bibliographic, hermeneutic, historical, and logical background, this paper gives a critical exposition of Smith’s interpretation. (shrink)

Lynne Baker was a trenchant critic of reductionist and physicalist conceptions of the universe, as well as the foremost defender of the constitution view of human persons. Baker was a staunch defender of a kind of practical realism, or what she sometimes called a metaphysics of everyday life. And it was this general “common sense” philosophical outlook that underwrote her non-reductionist, constitution view of reality. Whereas most of her contemporaries were given to metaphysical reductionism and eliminativism, born of a penchant (...) for so-called Quinean desert landscapes, Baker was unapologetic and philosophically deft in her defense of ontological pluralism. This volume honors Baker’s work by bringing together 16 critical essays by some of her students, colleagues, interlocutors, and friends. This study investigates factors impacting perceptions of ethical conduct of peers of 293 students in four US universities. Self-reported ethical behavior and recognition of emotions in others (a dimension of emotional intelligence) impacted perception of ethical behavior of peers. None of the other dimensions of emotional intelligence were significant. Age, Race, Sex, GPA, or type of major (business versus nonbusiness) did not impact perception of ethical behavior of peers. Psychobiography has been a topical area and an applied research specialty in psychology since Freud’s influential psychoanalytic psychobiography of Leonardo da Vinci. Throughout the last century, psychobiographers have emphasized the importance of anchoring interpretations of life histories in established psychological theories and rigorous historiographic research methods. One topical area receiving less attention in psychobiography is the critical relationship between the psychobiographer and her or his subject as it relates to the process of psychobiographical writing. The present article explores the phenomenology (...) and challenges of this relationship in order to ultimately propose practical strategies for navigating countertransference issues throughout the subject selection, research and publication phases of psychobiography. Freud’s psychobiography of Leonardo da Vinci is used as a model of the stages of psychobiography, the evolution of the psychobiographer-subject relationship, and the challenges of countertransference. In this paper I examine the phenomenological possibility of peculiarly theistic experience. I present and explicate William Forgie's very powerful arguments against the possibility of such experience and Nelson Pike's recent response to Forgie. I argue that although Pike's refutation of Forgie ultimately miscarries, there are good reasons for rejecting what is the central thesis upon which all of Forgie's arguments rest. After canvasing several of these reasons and recommending an alternative thesis, I conclude that Forgie has not succeeded in (...) establishing the phenomenological impossibility of theistic experience. Recent years have witnessed the publication of numerous articles that draw a critical alignment between ethics and caring. In essence, this theme suggests that caring is a moral pursuit centred on the beneficent attention of one person shown to another. Yet, if such language is to have real poignancy, it must be geared towards an inclusive agenda that meets the needs of all within the community. Research evidence suggests that this is not always the case, especially in terms of the (...) care offered to members of minority ethnic groups. This article will focus on the findings of a qualitative research study that explored the expectations and perceived experiences of nursing care among members of the Pakistani community in Bradford, West Yorkshire, UK. The findings suggest that nurses should develop a more informed narrative that readily reflects the needs of the Pakistani community. (shrink)

The goal of the modern scientific project, as defined by such thinkers as Descartes and Bacon, is "mastery of nature." Martin Heidegger, in an interpretation of mastery of nature that has left its imprint on post-modern critique of science, maintains that the essence of modern science lies in a projection of "technological being" upon nature. This projective "assault" has its origin in the "self-grounding" project of modern metaphysics, in which the human subject attempts to secure a self-sufficient position over against (...) all possible objects. ;The dissertation examines Heidegger's "technological thesis" from the vantage point of the history and philosophy of science. Adopting the vis viva debate between Leibniz and the Cartesians as a point of departure, it identifies and develops, historically and systematically, two themes upon which hinges the question of the technological essence of modern science and its relationship to the "self-grounding" project: the "rationalism" of modern science, and modern science's view of natural teleology. The main argument of the dissertation is that examination of the relationship between these two themes reveals the "teleology of reason" in modern science. ;Chapter's One and Two focus on Leibniz' disagreement with Descartes over the ontology of corporeal substance. From that discussion emerge our two metaphysical themes, which are addressed in Chapter's Three and Four respectively. On the basis of the results of those chapters it is argued that the problem of "mastery of nature" resides in a clash, indigenous to reason, between the intrinsic teleology of nature, through which nature is rendered intelligible to reason, and the teleology of reason itself, which is freedom. ;The conclusion shows that Heidegger ignores tendencies within science, and within the very self-grounding project itself, which run counter to his pessimistic portrayal of science as an "assault" upon nature. Finally, the prospect for a non-coercive resolution to the clash of teleologies in modern science through the "ravishing of nature" is considered. (shrink)

In his book Defending Life, Francis Beckwith claims that the question of personhood and human nature is the central question in the abortion debate. He further asserts that the unborn entity, from the moment of conception, is a full-fledged member of the human community. In this paper I try to show that the argument Beckwith offers for the moral wrongness of abortion in Defending Life is unpersuasive, his elucidation of key terms question-begging, and his claims concerning embryology and zygotic (and (...) postzygotic) development highly controversial. My concern in this essay is not so much with the invisible work or hidden labor produced by neoliberalism, but rather with what Joseph Pieper describes as an emerging culture of “total work”. More than the sheer number of hours of work, Pieper diagnoses a transformation in the way we view work. Work has become the exclusive point of reference for how we see and define ourselves. We are, Pieper feared, increasingly incapable of seeing beyond the working self. The (...) human being has become the human worker. Historically, the ideal of leisure offered a counter vision to this tendency. Michael Oakeshott notes that while human beings must attend to the necessities for survival, they are most especially distinguished by their capacity for leisure—by an ability to pursue questions, conversations, and explorations that transcend the realm of production and consumption. To overlook and exclude leisurely pursuits is to diminish our humanity. (shrink)

In this paper, I argue that dialogue between legal philosophers and social scientists can be mutually beneficial. Nicola Lacey offers a vision of jurisprudence that supposes as much. I start by setting out my interpretation of her view. I then defend its potential, which she takes for granted, from the challenges posed by, first, an apparent friend—Brian Leiter—and, second, obvious adversaries—Joseph Raz and others. My response proposes an alternative to their conceptions of legal philosophy, one that is consistent with (...) my understanding of the approach to jurisprudence that Lacey recommends. (shrink)

According to H.L.A. Hart's analysis, to utter an internal legal statement is partly to express an acceptance of a set of norms. This article attempts to defend Hart's conception of internal legal discourse by responding to the following three lines of criticism that can be found in Joseph Raz's writings: (i) that Hart's analysis fails to account for what Raz calls ‘detached legal statements’; (ii) that Hart's deployment of the notion of acceptance in his analysis vitiates his legal positivist (...) project because such acceptance necessarily amounts to moral endorsement; and (iii) that Hart is wrong to assume that normative practices, including discursive legal practices, can be characterized satisfactorily by deploying only descriptive statements. I argue that Hart's theory, or at least a theory along the lines that Hart developed, has sufficient resources to handle satisfactorily these criticisms. His world is a noonday world in which sharply outlined figures, most of them more than a little singular, act in describable ways against perceptible backgrounds. To address this problem, I suggest that Brandom should explain defective discourse in terms of what it is to treat some portion of discourse as defective. To illustrate this strategy, (...) I present an extension of his theory of content and use it to provide an explanation of confusion. The result is a theory of confusion based on Joseph Camp's recent treatment. The extension of Brandom's theory of content involves additions to his account of scorekeeping that allow members of a discursive practice to accept different standards of inferential correctness.
